Terms of service
1. Scope
These Terms and Conditions apply to all contracts for the sale of goods by SIA Elegance Echo, Ikšķiles iela 4, Rīga, LV-1063, Latvia (hereinafter “we”, “us”, “our”) to consumers via our online shop at https://steeljewerly.com.
2. Contract Conclusion
2.1 Binding Offer
By placing an order on our online shop, you submit a binding offer to purchase the selected goods.
2.2 Order Confirmation
We will confirm receipt of your order by email (“Order Confirmation”). This confirmation does not constitute acceptance of your offer.
The contract is concluded once we dispatch the goods (“Shipping Notice”).
2.3 Availability
Orders are accepted only for items displayed as available in our shop.
3. Prices & Payment
3.1 Prices
All prices are shown in EUR and include applicable VAT.
Shipping costs are displayed separately before checkout.
3.2 Payment Terms
Payment is due immediately upon ordering.
We accept all payment methods offered during checkout.
3.3 Failure to Pay
If payment is not received within a reasonable period, we reserve the right to cancel the order.
4. Delivery & Shipping
4.1 Delivery Area
We deliver to all countries in Europe.
4.2 Delivery Time
Standard delivery time is 3–5 business days after dispatch, unless otherwise specified.
4.3 Delays
If dispatch is delayed, we will inform you.
If the delay exceeds 14 days, you may withdraw from the contract.
4.4 Transfer of Risk
The risk of accidental loss or damage transfers to you once the goods are handed over to the carrier.
5. Retention of Title
The goods remain our property until full payment of the purchase price has been received.
6. Right of Withdrawal / Returns
6.1 Withdrawal Rights
Your right of withdrawal is governed by our separate Withdrawal Policy, which forms part of these Terms.
6.2 Exclusions
The right of withdrawal does not apply to goods made to order or customised (e.g., custom-engraved stainless steel chains).
7. Warranty and Liability for Defects
7.1 Statutory Warranty
Statutory consumer rights for defective goods apply.
If goods are defective, we may choose to repair, replace, or refund the purchase price.
7.2 Liability
Our liability is unlimited in cases of intent or gross negligence.
For simple negligence, liability is limited to foreseeable, contract-typical damages, except where life, body, or health are affected.
7.3 Essential Obligations
The above limitations do not apply where a fundamental contractual obligation has been breached.
In such cases, liability is limited to foreseeable damages typical for this type of contract.
8. Limitation of Liability
8.1 Exclusions
We are not liable for indirect or consequential damages arising from this contract, except where caused by intent or gross negligence.
8.2 Representatives and Agents
The above limitations also apply to our legal representatives and vicarious agents.
9. Governing Law & Jurisdiction
9.1 Applicable Law
These Terms and the contractual relationship are governed by EU law and applicable laws of Latvia.
9.2 Consumer Rights in the EU
If you are an EU-based consumer, you may also bring legal claims before the court of your place of residence.
9.3 CISG Exclusion
The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
10. Amendments to the Terms
10.1 Updates
We reserve the right to update or amend these Terms at any time.
The version in effect at the time the contract is concluded shall apply.
11. Final Provisions
11.1 Severability
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions remains unaffected.
The invalid clause will be replaced by a valid one that best reflects the original economic intent.
11.2 Written Communication
All notifications must be made in writing (including email), unless otherwise agreed.
